TERMS OF SERVICE

Agreement to these policies is captured via signed Airtable form submission at the time of onboarding.

Welcome to Expat Bloom Camps Inc. ("EBC"). These Terms of Service ("Terms") govern your use of our website located at expatbloomcamps.com and the services provided through the site. These Terms apply to all users, including participants (campers), featured influencers, camp counselors, community architects, contractors, and visitors. By accessing or using our Service, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Service.

2. Modification of Terms

EBC reserves the right to modify or update these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Service following any changes signifies your acceptance of the revised Terms.

3. Eligibility

You must be at least 18 years old to use our Service, purchase any EBC experience, or enter into any contractor or partnership agreement with EBC.

4. User Obligations

You agree not to engage in any of the following:

  • Violating any local, state, national, or international law.

  • Engaging in any activity that could harm or interfere with the operation of the Service.

  • Posting or transmitting harmful, offensive, or inappropriate content.

  • Attempting to gain unauthorized access to other user accounts, our systems, or networks connected to the Service.

  • Uploading or transmitting any content that infringes on the rights of others.

  • Introducing any viruses, malware, or other harmful code into the Service.

5. Code of Conduct

All individuals associated with EBC are required to adhere to the EBC Code of Conduct. Failure to comply may result in removal from the program, termination of contract or partnership, forfeiture of fees or compensation, and potential legal action.

6. Cancellation and Refund Policy

Applies to: Participants / campers

  • 30 or more days before camp start date: 50% refund of the total amount paid.

  • Less than 30 days before camp start date: Non-refundable.

  • Credit Transfer: The full amount paid may be applied toward a future EBC camp within 2 calendar years.

  • Force Majeure: No cash refund. Full credit honored for a future camp within 2 calendar years.

  • Affirm Purchases: Refunds coordinated with Affirm. Loan balance updated within 3-10 business days of EBC confirmation.

Days referenced above are based on the start date of camp. Some exceptions may apply at EBC's sole discretion. Contractor cancellation and compensation terms are governed by the applicable contractor or partnership agreement.

7. Intellectual Property

All content, materials, and features available on the Service are the property of EBC or our licensors and are protected by intellectual property laws. Unauthorized use is strictly prohibited.

By submitting any content to our Service, you grant EBC a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute such content for any purpose related to the Service.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. EBC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

EBC reserves the right to terminate or suspend your access to the Service at our discretion, without notice, for conduct that violates these Terms or is harmful to other users or the EBC community.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law principles.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the rules of Arbitration Services of Portland. The arbitration will take place in Portland, Oregon, USA.

13. Miscellaneous

  • Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and EBC regarding your use of the Service.

  • Waiver: Failure to enforce any right or provision will not be considered a waiver of those rights.
